In game overlay?
That is NOT an in game overlay. It is just a partially transparent window sitting on top of the GW2 window. No different than having a browser window open sitting on top of GW2.
No, that definitively looks like an overlay. I’ve seen one or two in my days.
The thing is, nobody other than a legal representative of NCSoft could clarify it for you, and let’s be realistic, the chances of one of them showing up here are smaller than an ice cube causing global warming because you put it in the wrong kind of soda. Which is to say, astronomically slim.

According to this, if we interpret it literally, just having GW2Stuff or Dragon Temple or anything similar in your browser history is grounds for immediate and permanent termination of your account.

“Does this program allow someone to play faster, better, longer, or more accurately than someone who doesn’t use it?”
No!
“Does this program allow someone to ‘play’ when he/she is not at the computer?”
No!
“Does this program allow the user to gain undeserved rewards?”
No!
So nobody will answer you officially it’s ok to use it, and you use it at your own risk. But in this case I wouldn’t worry bout legal consequences.

It’s our intent to allow API-derived apps like GW2Stuff’s overlay to be used by players. From our perspective, having an overlay is just a different way of presenting content. We are not currently banning players simply for using overlays, and have no plans to do so.
It’s not an in-game overlay. Run the program without GW2 running. It still runs and displays. It’s just an always-on-top window with transparency.

This policy was written before we had APIs available, and needs to be updated to make it clear that we encourage app development and usage. We realize that in its current form it can be hard to figure out what is acceptable.
Our hope is that the new policy will make it very clear what is acceptable, so that you don’t have to worry about getting banned by using an app. The new policy is still being written, and we will update you when it’s ready.
