You don’t always need to buy Black Lion Chest Keys to get them. You’re also not paying for the extras in the BLC, you’re getting what you paid for, plus a gift for nothing extra out of your end. So from the definition you posted — it is a gift.

…Seriously? Black Lion Chests usually contain X. For the promotion, they’re containing X+(3gifts) while the prices stays the same. That seems an awful lot like a gift to me. Yeah, you have to buy something first, but plenty of stores do “free gift with purchase!” promotion, and I’d say that’s pretty plainly within the definition you posted.

And if you’re talking about the fact that the items themselves are called “Wintersday Gifts,” that’s just ridiculous. They’re tradeable; give them to your friends if you have to be that pedantic about it.
