Q:

Is a grey market legal?
There is no real option to trade other then mail items and gold, and it’s pretty open for scamming players, but is striking deals outside of the trading post legal?war

A:

You have an option to trade which is the BLTC. The fees and taxes for selling on it are used for a gold sink to counter inflation and are vita lto the economy.

If you want to trade directly via mail, you do so at your own risk. As you said, its pretty easy to scam players that way and you wont get any support from Anet in that case.

Trading via mail does not breach the EULA but you are not allowed to use this forum to advertise your deals.

Be warned though that mailing big amounts of gold in game could result in a ban because it looks like you are selling gold.
I would just do trades per mail with guild members and use the guild bank to transfer the gold.

Wanze pretty much nailed it. The BLTC is there for a reason and if you do a player to player trade and something bad happens, they usually opt not to get involved, and that makes sense.

Also “dev call outs” are against forum rules.

Oh really? I never knew “dev call outs” are against forum rules, in that case won’t happen again.
And thanks wanze!

(BTW I did this sort of call out before and the specific dev actually responded and never noted me that, I really should sit and read the rules soon)

My guess is, it is legal. but not supported, so any problem you have going on grey market, Anet dont’ want to be responsible or waste human resource to help you.

Nothing stops you from selling item to your guildmates to save taxes. I don’t see how it is illegal. But Anet probably dont’ waste real money taking of people getting scamed.

Very recent change

Also-as others have said do it at your own risk and if scammed, no Anet help.

Despite Anet claiming that it’s not automated, I strongly feel that sending large amounts of gold results in an autoban/flag. That does not mean you are guilty, however.

If you send an inquiry and tell them your innocence (and they can check the logs and trace your transactions) they will reverse it, usually within a few days.

If you want to get past the autoban (this is not an exploit), simply transfer gold through guild banks.

Even if it isn’t automated, sending large quantities of gold has got to be some kind of flag since that pretty much the sole activity of gold sellers and thus the only way to find them.

Just be warned, OP, sending gold is risky, both from a scam and from a ban perspective.
