I always wanted to make a banking guild that would deal loans and whatnot. Unfortunately, after fantasizing about it for two days, I decided that it was either impossible or far too difficult to maintain such a guild while avoiding scammers, theft, etc.

That’s not a valid deduction, as John’s statement is clearly about interacting within the game as a playable character, rather than interacting with the TP at all.

Olba is correct, I am referring to interacting with the TP inside the game, I don’t have any official statement to make on outside the game applications.

I have personally known three people in game, through a guild I was in at the time, who have been banned or ‘temporarily banned’ for, and I quote, “Market Manipulation”.
These players were all legit. They all earned their gold through luck/farming/TP legit, or, through large gem purchases (one of them blew a very significant amount on buying gems to sell is my understanding). Regardless, they came into significant amounts of gold allowing them to buy large quantities of items on the TP.
In the case of the ‘high roller’, he did it explicitly out of frustration with mat pricing. So, he bought enough gold, legitimately through the gem store, to buy every single one of a certain item on the TP and jack up the price five fold.
Again, all in game interaction through legitimate means, yet, banned for “Market Manipulation”.
So, please, explain to everyone here how you can advise this individual that it’s okay when, in fact, it appears not to be.

People that use such programs should banned with a special in-game hammer that bashes on them while they have to watch how, each second, an item in their inventory is destroyed, and all their coin is slowly sucked into a virtual vacuum cleaner.

I would assume no, since there is an approved (somewhat API for watching the TP). Maybe the crew at anet needs to discuss what they will allow, but at this moment they gave people access to TP data it’s up to them how they think it’s breaching contractual rules. I can easily build the notifier based on web data pulled from the TP.

From Zicore’s website, although this service is not exclusively offered by Zicore, the notifier is described as follows:
It now also notifies, when you have sold or bought stuff. You also can enable notifications of transactions, when someone is over/under-cutting you.

You can be notified of being undercut in 2 ways: with, or without using your “session key”. If you use the session key, the notification is based on “live” information. If you don’t use the session key, you’ll be notified based on information from GW2 Spidy, which is “old”, cached information. People that download this program obviously want an edge over other traders, so one can safely presume they will use the session key to get live notifications.
Conclusion:
I believe the User Agreement and the Third Party Policy are crystal clear on this issue. Using the “session key” for live notifications of undercutting is a direct violation of User Agreement Rules 8 (h) and (i), as well as the Third Party Policy.
People that use a notifier create a huge advantage over players that don’t use a third party program. This a no-brainer any way you look at it.
The only possible reason I can think of why nothing is done to combat these clear violations, is that there is no way to enforce them.
Never issue a warning you can’t enforce. And since it can’t be enforced, no warning can be issued, either.

Never do things out of frustration. That only ends in disaster.
In this case, market manipulation wasn’t the proper term. I would have called is harassment of the entire playerbase. As you may or may not know, harassment, especially through frustration, is not allowed as per the EULA. Imho the ban was justified.

Perhaps market manipulation is too broad of a term.
Schemes such as pump and dump are generally frowned upon and fit in with market manipulation. I’m not sure if that is a bannable offense, though.
Manipulation schemes such as buying all supply or faking demand – I really don’t see how that is bannable
