As we all know, instance is tied to the person who created it and this will probably not gonna change any time soon, via technicalities, so, should there even be a possibility to kick him? Kicking instance creator results in instance being killed, so the only use of it is if you want to grief someone for whatever reason. Disallowing the kick of instance creator would save many of people a lot of headache.
That’s sort of a reasonable band-aid for a bad game set up I suppose. It would be nice if the real problem was addressed though.
In the mean time the only other thing I can think to do would be that either you start the instance yourself or have a trusted friend start it, I never let a pug start an instance if I can help it.
