You can always make the game with the theme “similar” to Guild Wars.
Like Battletoads was a copy from TMNT but it wasn’t the same, so no copyrights infringement.

Generally speaking, you have two choices when developing a commercial product like a video game. You can pay the owners of an existing property to use their characters/world/etc. or you can come up with your own original ideas.

For example, if you want to make a Star Wars video game, you can’t just throw Luke and Vader and a bunch of lightsabers into your game and start counting the cash you make. You have to obtain permission from the owner of the Star Wars name, characters and so on which – considering the popularity of the property – will involve sending them truckloads of money.

Less popular properties may be licensed for less, but you still need permission from the property owners no matter how obscure it is. The benefit to this is that you have a target market already prepared for your product, the trick is making sure the potential profit outweighs the cost of licensing the property.

Or you can come up with an original idea (or at least different enough from existing ideas to protect yourself from lawsuits) and create a market for the product. If successful, you may find yourself getting offers from other companies who want to license your property for their own products.

Thank you tolunart,

I understand it, But I can’t find way to ask “Guild Wars” owners about it.

I have an idea for a commercial venture (play, movie, action figure, etc) involving theGuild Wars or Guild Wars 2 world. Shall I send it to you?
Unfortunately, ArenaNet cannot accept unsolicited ideas or submissions. As a result, we will not be able to review or consider submissions of this kind. We will not view e-mailed submissions and must return mailed submissions unopened.

That is so sadly…

I think ArenaNet does not encourage such initiatives.

Andrey, they gave you the canned response for submitting content for them to add. I think you should go back to them and ask about licensing and using the world for your ideas.

Also, you might try emailing them through the ANet parent site rather than the game. I believe they may take ideas more seriously when you go through their marketing department rather than trying to get the support department on board.

Good luck to you.

A lot of people don’t.

Their intellectual property and their right to develop products based on it is the basis for their entire business. Without that they’d have nothing and if they start licencing it out to other people it dilutes their own ability to use their product.

Also I think the bit about not even reading or opening submissions is to cover themselves legally. If, for example, someone sent them details of their plans to make and sell quaggan plushies and asked for their permission to do it, didn’t hear anything back and then later on Anet starts selling quaggan plushies on the website that person could claim Anet had stolen their idea and seek legal action. It probably wouldn’t go anywhere, but by stating in advance that they don’t even look at ideas they’re sent they can cut the hassle off even sooner.

(Like how Lego totally stole my idea for a Lord of the Rings Lego set which I sent them in 1994 but deliberately waited until the movies came out so they could claim that’s where they got the idea.)

They wouldn’t officially allow you to license the use of Guild Wars because they wouldn’t want to take the risk in allowing you to officially tarnish their name. Garbage is garbage, but garbage with a seal of approval is now their problem, if you know what I mean. If you were a reputable company, then maybe, or if you made a quality product and then showed it to them, they might allow it, but with restrictions.

If you want to make a non profit game, they usually don’t have anything against that. It’s when you become too popular and/or begin to direct bad attention that they care.

If you want to be similar to Guild Wars, using the Star Wars example, simply do something like calling it Galaxy Battles, while featuring the main characters Vuke and Lader wielding their trusty light swords.

Here. Clan Battles, or Battle of Clans if you like. There you go. Now, go make it.

Tempting idea. But, in this case I cannot use names like “Asura”, “Sylvari” or names for skills, cities or locations I think.

No, but you can make the “Esuris” and “Silvarans” in your Clan Battles
