Q:

Recently another friend decided to leave the game but on his way out he sent me his gold and his account details….

Can I use his account without punishment? What’s the rule on this sorta thing? I have made my own alts before but I’m not sure what the rule is if someone gives you the account.

I mostly play for the new Free-For-All arena in PvP lobby.

A:

Sharing or transferring accounts is against the GW2 User Agreement and Guild Wars 2 Rules of Conduct.

https://www.guildwars2.com/en/legal/guild-wars-2-rules-of-conduct/

You may not buy, sell, transfer or auction (or host or facilitate the ability to allow others to buy, sell, transfer or auction) , or offer to transfer, sell or auction, or buy or accept any offer to transfer, sell or auction, any game Account or game Content, including (without limitation) game characters, character attributes, items, objects, currency, credits or copyrighted material, or any other intellectual property owned or controlled by ArenaNet, Inc., NCsoft, the Service, or our licensors, nor may you encourage or induce any other player to participate in such prohibited transaction(s), except as may be specifically authorized by the Service and by ArenaNet or NCsoft, without first obtaining our express written permission.

https://www.guildwars2.com/en/legal/guild-wars-2-user-agreement/

Additional License Restrictions – You acknowledge You will not directly or indirectly:

….
sell, sub-license, rent, lease, grant a security interest in, borrow, lend, loan, network or engage in any activity that could in any way transfer or provide others access to any Service, Content, Game, or parts thereof, including but not limited to any serial code number, access key or the like. However, this Section shall not prevent You from selling the original tangible storage medium on which the Game is contained.

Each Account may only be used by one person. If a minor has been allowed access to an Account under Section 9© below, only that minor may use the Account thereafter. Except as provided in Section 9© below, You may not make any assignment or transfer of rights, obligations or liabilities related to this agreement and any attempt by You to do so is null and void.

So, yes, you could find potentially find yourself in a bit of trouble if you do so.

Plus login confirmations and other communications would go to the original email, which I assume you wouldn’t have access to.

You can read the policy/rule about transferring accounts in the Guild Wars 2 Content Terms of Use accessed via the ‘Legal Documentation’ link below.

Good luck.

This is extremely helpful thanks. Pretty much a big fat NO to accepting GW2 accounts as gifts.

You’re welcome. Maybe your friend will change their mind some time in the future and you can continue adventuring with them. Maybe save some of that gold they gave you just in case.

Id be interested to know where in the Eula the OP is mentioned.
The Eula applies to the person who originally bought the game.
The OP is not doing any of the things that the Eula prohibits.
Its the friend who is breaking the Eula.

Probably these statements: You acknowledge that You must obtain the Game from ArenaNet to use the Game and that such software may have a serial code number / access key that can only be used once. and failure to comply will result in reasonable penalties, up to and potentially including termination for material breach.

From: https://www.guildwars2.com/en/legal/guild-wars-2-user-agreement/

“The Game requires Service, and Content from ArenaNet. You acknowledge that You must obtain the Game from ArenaNet to use the Game and that such software may have a serial code number / access key that can only be used once. You also acknowledge that You must obtain Service from ArenaNet to use the Game and You acknowledge that You are responsible for supplying any necessary communications connections (such as Internet access) and hardware to use the Game, as well as any costs or expenses related to the foregoing. You further acknowledge that Your full or partial access to Content, including one or more Message Boards, Teams or Items is conditioned upon Your compliance with the provisions of this agreement and the Rules of Conduct. ArenaNet may modify, remove, or add Content in its reasonable discretion.”

“Service, Content and Game License Pre-Conditions – You acknowledge that any ArenaNet license to use Service, Content or Game is pre-conditioned upon Your agreement to comply with all provisions of this agreement. Accordingly, You also acknowledge that any ArenaNet license to use such Service, Content or Game would not exist without Your agreement to comply with all provisions of this agreement, and failure to comply will result in reasonable penalties, up to and potentially including termination for material breach. You further acknowledge that use of the Game may require additional licenses, such as a license to any applicable operating system or other third-party software, and that You are responsible for obtaining and agreeing to any applicable third-party license before You enter into this agreement.”

Be careful what you ask for
ANet may give it to you.

The part that JustTrogdor quoted says: “You may not…buy or accept any offer to transfer, sell or auction, any game Account,”

It’s a bit buried because it’s after the part about not selling them, which uses the same long list of terms but it is in there.

Also just in case anyone is concerned accounts and account keys are two different things: you absolutely can buy a new copy of the game and give someone else the box or the key so that they can create an account (Anet actually encourage this).

This rule only applies once the account has been created. (I think it’s mainly to stop people buying accounts, grinding one or more characters to level 80 and then selling the account for profit.)

Read more closely, especially the very first and very last part of Just Trogdor’s post. Specifically

You may not buy, sell, transfer or auction (or host or facilitate the ability to allow others to buy, sell, transfer or auction) , or offer to transfer, sell or auction, or buy or accept any offer to transfer, sell or auction, any game Account

And

Each Account may only be used by one person.

I think, that both are very clear.

Actions, not words.

You can keep whatever gold and items he gave you. You can’t keep his account.

However, if he gave you enough gold from his account or you make enough gold selling the items, you could turn that into gems and purchase extra character slots or extra bank storage on your own account.
