Why does Anet let scammers happily play?
Scamming is an important part of the Online Experience™ and it teaches people to not be too trusting. All in all it’s a win-win situation for everyone.
In other games that supported player trading I would screenshot the player in question agreeing to the details of the trade (You agree to craft me this item in return for these materials and gold, etc). The very few times that people attempted to steal my stuff I just filed a ticket with the screenshot and got my items back a few days later.
Obviously Arena.net wants you to use the trading post but as Saturn.6591 mentioned Arena.net does state that “While playing Guild Wars 2, you must respect the rights of others and their rights to play and enjoy the Game. To this end, you may not defraud, harass, threaten, embarrass or cause distress and/or unwanted attention to other players.”
Scamming is a form of fraud so it’s against the rules.

Whee… being an EVE player, this particular thread amuses me grandly. I see people saying things like it is actually stealing and even one person saying it should be illegal IRL and only isn’t because the law hasn’t kept up with technology. All I can think is “Holy crap, they would just arrest EVE. Not a couple of players in EVE, I mean they would just arrest the entire playerbase if that was the case.” =D
And no, there isn’t a difference, because EVE has a system called PLEX which gives a real currency value to the in game items/currency, same way gems do with gold here, so yea… it’s rather amusing.

Edit- Personally, I’m thankful to MMO scammers. Seeing them in action in a setting that would only cost me virtual currency gives me a heads up on what folks IRL would do. You might chuckle at that statement, but I see EVE style scams on craigs list ALL the time. And guess what? I can spot em a mile away now. =D

Wrong. It is his fault. It is entirely his fault. The whole “never blame the victim” is incorrect. In this game trading is done through the trading post. You can not get scammed in the trading post. If you trade outside of it hoping for a quick cheap profit, you accept the inherent risk that you might (and probably will) get scammed. If you give that “Nigerian prince” 5k trusting he’ll come back with your promised million, you deserve what you get.
This isn’t a case of someone getting sexually assaulted because “SHE DESERVED IT!!”. THAT is when you apply the whole “never blame the victim” thing. This is a “nigerian prince” kitten. If you fall for it it’s entirely your fault. Be smarter next time.

If only there existed in MMOs this ability to pass items directly between two people in a safe manner… say, a window that pops up where one puts their items in one side, and another puts their items/money on the other side. If only such a concept existed commonly in other MMOs which could have been implemented here…
Naw. That’s crazy talk. Obviously everyone trading through the auction house system and losing money to their AH taxes was the most logical way to do things. Totally legit, amirite?
1. Guy sends stranger money in hopes of getting something in return…
2. Guy gets stiffed…
3. Guy complains and reports said person for “scamming”
4. No one gets banned here because both parties are in the wrong… original guy didn’t pay taxes on the transaction and the other guy just didn’t give the proper item…
5. Support probably chuckles a little bit.. moves onto the next thing.
Lesson here… Just don’t get greedy trying to skip out on fees or you will probably get burned and no help from the governing body you were trying to not pay taxes to.

But there isn’t. And actually there is probably a very legitimate “game-world-economy” related reason that I’m not going to bother going into here (and most people wouldn’t understand anyways).

They can’t arrest you for GETTING scammed. So the 99% of gullible highsec fools would be safe.
