Is it against the user agreement to make a deal with someone to buy directly from them using the mail system. And not using the tp?

No. They cannot guarantee the completion of the trade though. In other words, you can’t cry to them if you get scammed.

I’ve seen so many people cry because the “seller” didn’t send the legendary after getting the money. I wouldn’t risk it unless you know the person well.

It’s only against the rules when by “buy” you mean real money outside the game.

Trading post was invented for a reason

the transaction would be from a real life friend. so I am not worried about a scam at all. I just wanted to make certain it wasn’t something that is bannable.

It’s NOT! A problem and ANET are happy for you to do it.

Some friend could even give you one for FREE and it would be fine also.
