No new hair styles. I think it was an obligatory “new” just to get people to buy these kits, in a few weeks there should be more hair styles since there is an NPC in SW that has a new hairdo.

It looked more like a recycled ad to me, as the illustration was of hairstyles already available. I think they can justify the somewhat misleading ad by saying it’s new to people that never used a kit before … a tad cheesy, though. I’m fortunate enough to have a kit or two in my bank just to fiddle with looks without ever using the kit, so I double checked and confirmed there was nothing truly new on offer.

They actually are new. Maybe not new as of this sale, but they are new nonetheless.

To be labelled new they would have to never have been released before. Since they were already advertised as new before advertising them as new again is false advertisement (not that I care that much really, but I would understand the disappointment of someone who spent real money on them).

False advertising for sure. It doesn’t matter what is stated in a ToS or in a contract, if it is not conformely (or if it is against) the law, it is null. That from the legal point of view.

And yes, “new” means “new”, not “oh we released it several good months ago but we consider them new”.

Of course I will not take them to court for 10 or 20 bucks. But it just makes ArenaNet look pitiful and tiny tiny. You know that feeling of “just don’t tell me that it’s rain” when someone lies to your face. When you feel ashamed for them.

some posters on here think anet can do no wrong. they aren’t new they were released months ago end of story. i kind of fell for it too but i checked dulfy, any time there are new hair styles dufly will have posted a gallery of all the new styles.

it was an over sight, people make mistakes. one would think however that they would have someone proof read things like this.

False Advertising:
- Any advertising or promotion that misrepresents the nature, characteristics, qualities or geographic origin of goods, services or commercial activities

This sale is disappointing and definitely misleading in my opinion. If I didn’t read this post first, I would have believed the wording of the promotion. True the pictures are of older hairstyles, but most of us are beyond the reading level of picture books and are capable of interpreting words in advertisements.

We are at an age where pictures in advertisements are often misleading in order to make a product appear better than it is (very noticeable on many fast-food menus for example,) but I find the wording of this advertisement insulting to the intelligence of its customers as well as to the English language.

If there are no new hairstyles along with this advertisement that specifies “new hairstyles,” I feel they should release their newest hairstyles now if they have any, reword their advertisement, or simply take the advertisement out of the gem store. There is no reason for legal action, but those who spent real world currency are well within their right to demand a refund for a service advertised yet not adequately delivered. These are my opinions.

One final note: be careful about what you post regarding this issue. This is taken from the GW2 Forum Code of Conduct.

I very nearly converted a bit of gold for a hairstyle kit just to see what the new styles were. Very happy I didn’t.

Very bad form, Anet. If intentional (which i doubt), then an incredibly low tactic. As it is, this is what happens when you don’t check what you are sending out thoroughly. Perhaps saw these were what went out last time and decided they would do.

Ultimately, it can very well be misleading. Not everyone is aware of the what the “premium” styles are, and so may have been taken in by the nice little picture, or the statement that there are new hairstyles.

Of the premium hairstyles available, none were released at the same time as this advert was aired this time, so ultimately, they are not “new” hairstyles. By most people’s definitions, and almost certainly the definition of any EU or US court, these aren’t strictly speaking new.

I would hope that Anet would refund anyone who bought a kit in good faith in response to this advert, should the individual wish it, and further, I hope they learn and do a much better job of proofing what they send out. A promotion is usually good enough without needing an (accidentally retained) falsehood to sell it more.

It’s actually sound and not false at all. Your perception of the phrase is what makes it misleading. You can quite certainly get a new hairstyle by using the kit, by trying out a style you haven’t before.

Remember, Anet/NCSoft owns the contents of the game. You paid for the ability to access it. That’s why they can ban you and you can’t sue them for theft of your belongings.

I think this was just a big oversight, albeit an extremely sloppy one. I too, snap bought a kit thinking new hairstyles were in. I’m not willing to make a whole fuss about it, and I certainly will use the kit anyways. However, I would heavily suggest they remove that advertisement, as it is 100% false.

I can assure you that my intention was not to bring to court or take any legal action. I just wanted to draw attention that in the gemstore there is a false advertising and the wording should be changed, as companies can never be careful enough on this type of matter.
Do not get me wrong, it’s highly probable that I would have still bought the make-over kits just because they were on sale (I use at least two a month, I can never make my characters look good enough, lol) but the whole thing has left me with a bitter taste.

Interestingly enough, the only definition I can find under any form of official “legalese” regarding the word “new” is “Not used”.

So, I mean, by the definition you cite, any advertisement cajoling the viewer to “try a new style” or something similar would be, effectively, false advertising, since the style would only be new to the person, not to everybody? Could you point me to anything official stating that definition, or maybe some case law where someone was suckered by the word “new” to think that what they were getting was something that never existed before, not that it would be a new thing to them?

Did. Couldn’t find anything. You’d think it’d have been in some sort of list of legal definitions, like how I found the definition of “new” to only be “not used” or “not previously owned”.

Still, their actual announcements (website and game loader) say nothing about new hairstyles, the styles in the picture are clearly old, and there wasn’t even a patch that could have included new hairstyles, so I’m pretty sure that at no point did they actually say there were hairstyles entirely new to the game. You could use a hairstyle kit to get a new hairstyle. That’s fact.

Vague? Yes. False? No. Something anyone could really sue over since the only claim they could make would be paying for the gems, not for the item itself, as they don’t legally own anything on their account? Doubtful. Winning a lawsuit over digital goods that were exchanged on the game would set a precedent that the player has legal ownership of the goods on the game, in which case getting banned would be illegal.

There are old hairstyles and there are new ones. They’re new compared to the old one. New coke was new coke for it’s entire existence.

New doesn’t have to mean brand new. New York is definitely not new.

You’d lose a court battle for it, but it wouldn’t matter since Anet would give you a refund anyway if you asked for it.

But it’s not false advertising.

I find that to be absolutely adorable.

as a person coming from an EU country I find false advertising to be really serious and not a laughing matter. It’s taken seriously here by law and any country that deals with EU but false advertises gets punished, likely by fines.

I believe here in the states its “new” for 6 months…. So ArenaNet is barely squeezing in under that line, I think? Don’t get me wrong though, I’m not here to defend their cheesy marketing tactics. But it is what it is.

New Coke is a brand name. Are you saying that the last three hair styles were named New Hairstyles? I don’t see any evidence supporting this.

Anyway, I’ve found Anet to be pretty reasonable with refunds. And this looks like it was just a sloppy copy paste from when those hairstyles were new. But it is amusing to see how far the defenders will go on this one.

Something has occurred to me for those who bought a kit thinking there would be something brand new in it: You wanted the new thing, right? Well, if and when they do introduce new styles and faces, the kit you bought this week will have them, and you would buy it at that point.

So while it’s unfair that you didn’t get what the ad led you to expect, odds are pretty good that the kit will actually become what you want later on. In the meantime you can park it in your bank and “use” it from there whenever you like to fiddle with looks just for fun. As long as you hit Cancel or close the window without actually making the changes, the kit remains intact. I have a few kits in my bank thanks to achieve chests and BLC’s, and I use them exactly that way. They do get the new looks automatically when ANet makes new ones.

I’m not defending the ad as such. I think it was a rather unfortunate mistake by ANet. But I do think it’s a fairly small issue, easily corrected, and not worth the high dudgeon some are demonstrating.

I’m so sorry for your confusion, and I have passed along your comments to the BLTC Team and to Customer Support. I am sure they can figure out how to amend this for those who require it, and I imagine they will examine advertising to ensure it’s as clear as possible.

NOTE: I am 100% positive this ad was not an attempt to deceive or an effort to sell makeover kits to those for whom the hairstyles were not, truly, new to that account holder.

This is not a matter for legal discussion, and as pointed out above, legal discussions have absolutely no place in this forum, any more than ridiculous cries of “Freedom of Speech” are relevant for private game servers and privately-hosted forums.
