A Guild cannot “own” an expansion. a guild is a group of players, and some guild content will only be available to those players who have the expansion. for example, a non-HoT account will be unable to visit guild halls, I believe.
From how i understand it, your guild members need to have HoT to be able to capture one of the guild halls. Since they need to be able to get there.
So yes all players who help capture your Hall, need HoT.
I very much doubt a single player can get the hall by them selves.
Or players who do not have HoT cannot acces the guild hall only the Initiative HQ regardless of others in the guild (thus pressuring everyone into buy the expansion)?

Guilds are about building community. Splitting guild features across expansions is detrimental to that.
Guilds interested in the new content will recruit HoT users and kick vanilla players.
Guilds will become split making many guild an either/or situation. New expansion players will only want to join guilds that participate in HoT guild content.
Because so much functionality is moved out of the guild panel and to the guild bases, existing guilds that don’t buy HoT will effectively have content being TAKEN AWAY from them. All that influence, consumables, upgrades and the like are going to be applied to a guild base THEY DO NOT HAVE. Meaning they get NOTHING until they upgrade.
No guild missions, no more consumables, no wvw benefits. Nothing.
Without HoT guilds will be nothing more than a glorified chat channel.

I am more interested what happens to those members who do not own the expansion. If a guild has enough people with HoT to claim the guild hall. Will non HoT member have access it? Will they have access to the small HQ only?

This is what I’d like to know as well. Right now, my usual way of dealing with marketing kitten-ups like this one (i.e. not buying HoT) is very much conflicting with my desire to buy it anyway and go play with my guild. Well kitten.
Add this to the growing pile of things we still don’t know about HoT while being expected to blindly buy it anyway, and it does not make this situation any better.
(Honestly, I love the guild halls, and at this point, an open letter/commentary from Anet addressing this issue in a way that makes me feel like I’m still a customer they value instead of a cash-cow who’s too old to be milked properly anymore would probably convince me to buy this at launch, regardless of the price tag. Now? I’m already kittened that I probably won’t be able to go with my guildies to claim the hall…)

If they don’t allow non-HoT-buyers to enter guild halls, this will split guilds — of course, it’ll also force some players to get HoT earlier than they would otherwise. Will the extra money Anet makes from this be worth the player discord? We’ll see.
If they do allow non-HoT-buyers to enter guild halls once your guild has established one, then I see a market where non-HoT-buyers will pay those who have HoT to open a guild hall for them.
My interpretation of this is that as long as at least one of your guild leaders/officers with sufficient permissions owns HoT, your guild can claim a guild hall.
Whether or not guild members without HoT can access the guild hall (Given the instant teleport nature of it after being claimed), I do not know and really would desire clarification on. I sent a support ticket about this and support said they didn’t know, so yeah…
The way I read it: you need enough active guild members who bought the expansion AND join in a quest (probably simular to completing a dungeon) to touch that crystal. So, suppose you have a small guild of real friends, lets say 10 in total, and only the guild leader and 2 others buy the expansion, your guild will probably be unable to complete the quest, because its too hard for such a small group. And IF you complete it anyway, the other 7 cannot join the new guildhall since they don’t own the expansion.
I honestly hope they don’t screw this up. Honestly, they should have added guild halls out of Lion’s Arch and had them for everyone. They need to rethink this.
