Remove passive play
I know what you mean. But it’s not going to hold any weight unless you elaborate.

& And in this case “Remove passive play”
and refuses to spare the life in return for the surrender at discretion (unconditional surrender)
of a vanquished opponent.

There is no way they can do this. The whole game is skill-less and more skill-less things have been promoted over time. The current situation is so saturated with passive play that reversing it is simply not possible. Bad analogy but it would be like trying to turn CoD into a startegy and not a twitch based game. It just can’t happen.
People need to remember all the skills and traits can’t be balanced only for pvp because even if a trait is useless in pvp it needs to be there for pve perhaps. Dungeons, fractals, world events.
That is what you get when you play an MMO. It is a game which by design isn’t pvp orientated and which has competition simply for the people not skilled enough to compete in other games. Most mmo’s do it via gear but this game does it via passives and spam.
