Ingame description of this achievement is: “Acquire 40 skill points from skill challenges or leveling with a character already at level 80”.

I get progress towards this achievement when playing a character that is not level 80.

I think the “leveling with a character already at level 80” part is so that people understand that even when they are max level and have done full map completion, they can still earn 40 skill points (every time the xp bar hits max again, a level 80 character earns another skill point).

It’s not restricted to a level 80 character – it’s just 40 skill points from any method (skill challenges & level ups).

Well, I believe the description is meant to exclude bought skillpoints, like from FotM relics.

Actually those should work as well. I used ‘Sea of Sorrows (consumable)’ and it gave me 5 pts in the achievement track as well.
