Looks like what was feared would happen has happened. Well done devs the illegal way of not allowing people to remove their CC details has just caused this guy to suffer fraud against him. Well Done.

This is what probably happened, got details from database from whatever site to login, they bought £200 worth of diamonds, waited for the price of diamonds to rise then resold them for game gold. And transfered gold in some way to other characters to be sold.

To be honest with your friend he is best to wave a law suit in front of the dev/publisher’s noses, because they have broken the Data Protection Act for not allowing data to be removed normally within the game and also not allowing any security measures from repurchasing (it should at least ask for the 3 digit code on the back of the card, and expiration date again).

And for the fact they have known about this issue from other people reporting it and doing nothing, should have ruling bodies come down hard on them and revoke their ability to accept credit card payments etc.

it was only 3 or 4 I cant remember but it was not an outrageous amount. Pretty sure it was because they have no proof and I kept asking to be sent a screenshot of what I supposedly did.

They can’t give you a screenshot, they don’t see things as you do when playing the game, they have logs etc. Obviously the nature of the logs they can’t give you a screenshot of that either.

The EU has one set VAT charge per type of goods, so no matter where you are in the EU even if the company is or is not in a country that is a member of the EU, the consumer will stay pay the same rate.

As for the price increase in terms of pounds vs dollars for diamonds, you forget that ArenaNet isn’t operating from a 2nd seller on the channel islands so is them subject to other taxes also. So they have to offset the costs to the consumer, so the consumer in essence is paying for those taxes plus the VAT also.

And again you are making a rather silly point regarding extra expenses, they are using the same US prices in alot of other countries there is Euro , pounds and dollars that is the 3 pricing schedules they have.

I understood exactly what you said and it is wrong, VAT on goods is set by each EU country, it may be different per type of good but it is also different from country to country. What they have is an agreement for most items meaning that they will not charge local rates on goods purchased within the EU when they are brought into another EU country with some exceptions such as cars.

So to simplify since you appear to be having issues,
Is there different VAT rates for different goods within a single country yes
Are those rates the same across the EU NO.

You are starting to contradict yourself to be honest.

I originally said any goods coming into the country and not being a member of said state has to have the VAT of the country it is being sent to applied. Said that a few times now.

Yes each country has their own tax levels, but EU-VAT is different. If goods come from a non-member state then it qualifies for a Distance Sales VAT rate which is static if below the value of 100,000 euros.

The company does not pay the VAT or the Duty you do to the courier, the company has nothing to do with that. You are also not liable for their sales taxes of that country as it is an export. Unless it is purchased within the EU in which case you pay the EU countries sales taxes not your own and do not have to pay duty/VAT in the UK. That is how importing most goods work. In the case of digital downloads which are classed as a service it is the place of supply that takes precedent on VAT rates. And FYI the channel islands had the way their VAT on goods changed over 6 months ago.

1. I did not once say the Company pays the VAT, I have said several times the consumer does.

2. Yes the consumer does not pay the sales tax, the company does, but the company can add it onto the price to cover costs.

3. Yes although not entitled to you pay the country of origins sales tax to sell to the UK which is then added to the cost you pay, no-one is doubting that.

4. If it is shipped into the UK or not you will pay VAT whether you like it or not, unless you are thinking about duty free goods, this is only applicable if the person is coming from abroad back into the country and there is an allowance.

5. Actually the channel islands have been exempt from specific taxes for a couple of years now, and Amazon (among others) has used them for that length of time as a distribution centre. The islands are also a tax haven for the rich, where they can avoid paying 50% on money earned over £250k in the UK and just pay 1%.

LISTEN IT IS RATHER SIMPLE….

IT IS NOTHING TO DO WITH THE COMPANY OR WHERE THEY ARE BASED.

Hence why depending on the item if you buy from the US through other channels it costs a lot in shipping fees to the UK, the reason being to cover sales taxes etc plus the VAT.

The company has to sell to you at their normal price they offer or choose to offer + taxes they incur for doing so + your VAT rate.

At the moment the company has no choice but to sell at your current level of VAT etc, that will change in the EU in 2015 when a law is passed for the company to be able to choose their own rate or the country of the consumers rate.

It is amazing how many people think its the other way around, including laws, people still think buying from an American company while the consumer is from the UK, means they have to adhere to American law. When that isn’t true either.

You know how hard it would be to get 50,000 a month for a guild without the tome of influence and having 50 people with it?

The highest award is 100 influence from a server roll call per player in the guild online at that time. And that is a rare thing, not a daily thing.

I was not playing devil’s advocate, I was only pointing out the differences in laws between a company who’s sole base is the US or a company who has registered bases in different companies regardless of whether they trade internationally or not.

The reason for this is I have actually worked in this field for many, many years. The point I had been trying to make was the fact that unless they specifically traded within EU, a la Microsoft and those other things, with registered parties within these regions, an online shop that operates all be it internationally only needs to comply with the laws of the region that they re registered with, e.g. Gamestop.com, if I purchase form their website I am bound by US laws. If I buy from gamestop.co.uk I am bound by UK/EU laws.

As someone has pointed out though, if they are processing through a company registered in the UK, NCSoft UK then that is different and as I MYSELF stated above, even if their details are stored in the US, if you have provided them to the UK division of this company they still have to provide the same level of data protection as in the UK. This was something I have already said.

That is not true.

For instance, if myself (from UK) bought GW2 through the official site, then the point of sale is from my PC, and the goods are also sent to me. Not only that VAT is added per UK rates for the game, which would be 20%.

Its not about where the company is or how they trade, but the fact is who they trade with, if they choose to sell to the UK then they will be bound by UK law for all sales there.

Difference is, if I chose to sue them, if it was of a matter of the purchase I can sue them in the UK, if it was through other things like deformation etc by Arenanet or NCsoft staff then I have to sue them by law on where they are based.

You knew what was involved with the deluxe editon, you knew what you would get.

Yes and the Tome Of Influence being reusable would be a HUGGGGGGGGEEEEEEE advantage for the guild against guilds who don’t have anyone with that item, especially against a guild who may have a lot of people with it and can bump the guild en masse.

Imagine 50 people in your guild, and every 4 days they can increase your guilds influence by 50,000, it wouldn’t take long for a guild to buy pretty much everything. So yes it is a huge advantage.

as i pointed out in another thread, most of the people who have been help are the ones doing the Karma exploit issue and are getting they account reinstated.

Thats great for them, but that doesn’t mean anyone elses issues are less important, what about the people who can’t even get on the game because of account issues? They less important?

Its not really a pay to win, its more of don’t waste your money with how it currently is.

That depends on several factors, where the company is based if it has a base in europe, Also the US has sales taxes too, several other countries which are using the US dollar payment method also have the same price as the US but have the same taxation as the UK. VAT is also 20% not nearly 37%.

Who said anything about 37%?

And also its nothing to do with where the company is based, this is a huge misconception, if they trade with someone in the UK, that person has to pay VAT, some businesses can try and avoid some sales taxes by re-selling in the channel islands like Amazon do to keep their costs down, but that doesn’t benefit the end user who still has to pay the VAT.

Not all VAT is 20% btw, but in terms of Digital Goods or Physical Media it is 20%, but depending on what item is bought it can range from 20% to 10% to 5% to 0% (food is 0%)

Dear Arenanet/NCsoft support staff,

You cannot put all your support staff on the hacked accounts issue, yes it is a severe case, but people with other problems and/or queries are not less important, these people paid for a game that isn’t 100% for them (obviously excluding specific bugs in game or game performance issues) depending on their problem.

There should be at least people dealing with the other issues at the same time, things would then go quicker and you would have less people complaining on the forums since for most the issues can be fixed within minutes.

I shall put this also in a seperate thread for others to see. As I feel staff are being unreasonble to all users in their methods of resolving tickets.

@Azantah those items are one use for a reason, having even a 4 day cooldown on them will just mean they will be abused, and if for instance a guild doesn’t have deluxe or CE peeps in them, they will have to work much harder to the point of being too difficult to gain the same benefits, compared to just now as just work more to gain the same.

Essentially your ideas are more a pay to win which nobody will want, because it would cause a huge unbalance in the game.

No matter where the business is based, if you practice or sell anything in other countries you are subject to those laws also.

Just ask Microsoft and how they have paid hundreds in millions in fines for not giving people choices on what media player or browsers to use in Europe. Which they then were forced to remove and force people to download if they wished to use and allowed the browser choice app.

But in your example this should not have happened, after all Microsoft is based in the US, so why did they get fined for approximately 500m Euros in Europe? Thats right as said they were trading in Europe and are subject to their laws.

Again in your example, that would mean I could goto the US, shoot a citizen while on holiday but can’t be tried under US laws, which means I could go home safely? See how silly your argument sounds now :P

All due respect Freyar when a company keeps your details on an account with no option to remove it, they are going against the Data Protection Act right away, then if your account gets hacked, they can mass buy diamonds, change the diamonds for gold and sell the gold for money.

There SHOULD be an option to remove that data, it is law for it to be there.

Deezlar out of curiosity since I haven’t used the gem store with a CC. Can you perhaps clear your cookies and browsing history, because the gem store is basically a browser based system. Then try again.

@Dahgoth – Difficult to allow 2 different connections from 2 different modems with different MAC addresses. Would require someone knowing you, your static IP address, your modems MAC address and your account details.

But you do realise Point to Point Tunneling requires a lot of work on both ends to use, and is mostly used for VPN purposes. I seriously doubt your ISP is allowing you to browse the net on a VPN, that would be the stupidest thing ever, everyone would be guilty of port scanning someone on that ISP if someone reported them.

Lets be honest, you have been caught out, just admit it.

@Dragonlord – I think they may have banned people for the amount of Karma they had, like in the 100’s of thousands perhaps :P And then checked logs to see if they bought and resold the same items over and over. That would show they knew about it.

I tried, figuring £8.50 was preferable to some filthy hacker draining my account.

That is correct, they cannot hold information like your CC details without your authorisation to do so, if you did not allow this by clear instructions (being in a TOS you accept is not acceptable) then they are holding your information illegally. Especially if there is no options to remove it.

Data Protection Act 1974 and all that jazz.

Its one thing to spoof an IP address but to spoof one with constant connection to a game is another thing, which means someone has to have set up a proxy with your IP addy, which means someone in your home had to do that so someone could connect to you.

Then there is also the chance of getting the right IP address you have been using originally from a potential of 10s of thousands, depending on your ISPs IP range in your area, then getting your account details correct also.

To be honest OP, its looking more like you did it.

When copy and pasting the link in an email, make sure you don’t use a mozilla based browser, for example firefox or chrome. Use others instead, IE, Opera, Safari etc.

That way it won’t ask again, its a bit of a pain if you are dynamic DNS then you may get it all the time >.<

I agree. The 175W I mentioned was the GPU only Wattage being used at full load, not the system. The full load 350-400W is the entire system.

Anyway, getting higher than 500W PSU is always a smart move for future builds/upgrades. But it will not hurt anything if he got the 500W. (as long as it is a high quality one)

No Idle is when the GPU isn’t in use, full load is when its fully used with all hardware features running, then it requires the more wattage.

Same with Motherboards+CPUs idle its around 45W, full load its 140W-ish.

This is not entirely accurate. The wattage in tests and reviews that you are seeing is being pulled from the wall. In other words, it is the cumulative wattage being used by all components. The 690 I can imagine using that much as it is 2 GPU’s if I am not mistaken. On top of that, the 600 series cards are notoriously power efficient. The wording I gave made it sound like it was the card requiring 550W + 140 for the motherboard.

But I did mean for it needing 550-600W all in, but advised getting an 800W just incase for future RAM, optical devices etc added later.

Plus 175W is idle power consumption, full load is 350-400W.
