german band stealing artwork as album cover
is this copywrite infringment?

Not the band’s fault; it’s the graphic designers. They paid him to make an album cover, he right-clack saves an image off the wiki, adds their logo, gives it back, “DIS IS NEW ALBUM”.
But yes, this is illegal of the designer to do so. Unless the album is strictly “1 copy for the lead singer, and he’ll never use it for commercial purposes”.

Pretty sure that’s a paid stock; meaning they had the rights to commercial take advantage of the photo.
Why would a million dollar company risk that much, over 2% of an in-game splash image, one of hundreds? They didn’t.

It’s called matte digital painting and is HUGE in the gaming and digital art community. I doubt it was used illegally. Many of the loading screens use this technique because they are mostly photographs sketched over. The Buddhist temple in Tibet is also on the frost gorge sound screen :-)

If a band hires an artist to make their cover and the artist uses copyright material to make the cover the band can still be liable. It is the responsibility of the end user to ensure that any material they use does not violate copyright law.
If I hire a band to make a CD and they use a bunch of copyrighted songs and then I sell the CD, even if I didn’t know they were copyrighted, I am at fault and will get in hot water fast.
However, the end user would most likely have some grounds to take legal action against the designer for damages caused. It would be the responsibility of the end user to prove that they didn’t know the artwork was copyrighted. That in itself would prove tricky because “I didn’t know” can be hard to prove.
So basically it would work out in this order, band/producer gets in trouble, band removes the images and pays any fines etc. for using copyright material, band then sues designer for damages. Copyright law is more strict than ever due to millions of Internet violations. It is rare that the “I didn’t know” excuse gets some one very far.
It is the same reason that someone can get in legal trouble for owning stolen items.

Copyright is weird to me because it prevents my generation from re-using works from their own era. I’m not defending this band, just stating a drawback with non-creative commons works. Hopefully the designers at least cited gw2 as the source for the image. Nevertheless…this should be seen as tacky regardless of the legality of the action. It’s weak sauce, at best.
now heres what we gonna hate that this “band” then sees someone using the original artwork and they ll try sue them to oblivion or something for stealing their art lol xD.

You do realize that drawing something from reference vs. copy/paste-ing someone else’s artwork is not the same thing, right? x.x
On the picture you posted I believe that no photoshopping happened (ot I hope so?), but painting – using the photographs as references. :/
I have seen a band steal another bands cover artwork, so not really surprised. It was a death metal band used the ELP’s Brain Salad Surgery and put their own name on it. The cover even still said ELP so I’m not really that surprised. Also would also say the band probably didn’t get a graphic designer to do the cover to save money.
Also painting over stock imagery is completely different to just stealing artwork.
