1 thing can explain. they need money to survive. pre-purchase can gave income NOW.
any also explain why they release new item on TP more frequently. cut of the team to develop LS. half year item. this can cut off lots of cost.
Interesting reading, for those who are sure that only those being vocal are those unhappy with the HoT situation.
Great post, as I have a background in sales as well.
I’m a big believer in #3.
3. The probability of selling to an existing customer is 60 – 70%. The probability of selling to a new prospect is 5-20% – Marketing Metrics.Which is why bundling the core game with HoT DOESN’T make sense.
I agree, but those 60-70% are automatic “in the bag” sales, no effort required.
Here’s what I’m thinking. Somewhere in this thread there is a link from the Korean(IIRC?) securities/stock exchange which basically stated that 2 million copies of HoT have to be sold. Bundling the core game with HoT allows sales of the core game to be counted as HoT sales and vise versa which COULD NOT be done if the core game was a stand alone purchase.
Not including the character slot seems a lazy way to inflate earnings so they can make their salestarget.
Instead of relying on giving the existing customer value and hope on more word of mouth and goodwill to drive gemstore sales, they went for the cynical cashgrab.

This is good to remember. People that say they know the majority of players are angry/quitting the game/not ever going to buy HoT are simply exaggerating.
Exaggerate no more. I am gone from GW2 and may very well not return. Arenanet has done a real disservice to this long standing player who was part of this franchise going way back to GW1.
Out of here,
If they don’t address these problems soon, and satisfactorily, I’ll probably be joining you.
I’m mad but I most certainly didn’t want this to happen. I guess it was unavoidable.
I’m giving them an opportunity to rectify the error.
But it’s a limited time offer (they should understand that concept).

OMG, people are still going on about this? Have you ever played wow,ff14 or any non f2p with expansion? They all do more or less the same thing, and those are p2p games. You also should not buy any new release video game in the future too cause eventually they go on sale and you spent way more than new players. Gosh.
It will likely keep going until ANet says something about it. Then there will be responses to that before it calms down. Depending on what they say will determine how quickly or how much it dies down.
This is already diving down, there are way less people complaining than a few days ago. Also here is a fact , majority of players are happy with pre purchase. I’m not talking about people on forum, I’m talking about people in game. Just go in game and ask at lion arch or any other major hubs. The majority of response I got are positive. People who are unhappy with the situation are more likely to go on forum and complain.
Then why when I asked in-game most people said they wont buy it as is?
I am taking screen shots right now for a survey, and I will make a thread for it later. Wait and see.
Even if youre right. Most people who arent going to buy the expansion dont even log on any more so that can easily explain it.

Did you expect it to be free? Of course you have to pay for it.
I wasn’t ever expecting the base game to be free either, but hey, look at that.

Almost completely stopped playing due to lack of content, and now you have ensured that I will definitely not be coming back. Bye bye!
By giving you more content? The very lack thereof that made you almost stop playing?
Jeez, the logic of some people..
Except they’re not giving it. They charge the price of a full game for it. It probably has less content than a full game and they ticked existing players off by throwing the core game with it for free for new players but not giving them a discount.
Did you expect it to be free? Of course you have to pay for it.
“It probably has less content”. Yeah, you don’t know how much content it has, no one knows.
They didn’t tick me off for giving new players the core game for free. I’m actually happy for the new players. It helps the game to grow.
If the goal was to grow the game they could’ve done a simple $1 off expansion for each core sale referral. And left core cost at $5. They would’ve not only gotten people to strongly promote the game (in an attempt to get HoT for free) for them, but they would’ve made significantly more money. Instead of $0 for core, even a single referral would bring in $4. And HoT could’ve stayed at $50.

I can understand that some players are big fans of the game, and have full confidence in Anet as a company. What I do not get, is that some players proudly announce how they’ve forked over $50 or more for a product that isn’t finished, has an unknown release date, and unknown contents (although what we know of the contents does not justify its price tag).
What you are basically saying is “Money has very little value to me”. And while I understand that some players know they will get the expansion eventually anyway, I don’t think that supporting this business practice is a good thing. You are basically part of the problem by supporting this pre-purchase nonsense, which is bad for us as consumers.

For some, simply announcing a new class is worth $50, or a new map or specialization or whatever. People view value differently, for me $50 + another $10 for a slot is not a whole lot of money but its by no means worth throwing away (my issue isn’t price, its principle). Maybe for Johnny down the road, $50 is a lot of money, maybe Johnny works twice as hard as I do for a lot less pay. Maybe the added $10 for a character slot is the difference between his kids getting lunch for the week or not having lunch.
The same can be reversed, some people have or make much more money than the rest of us so to them $50 is next to nothing. Some people throw $50 away on something many of us would view as insanity.
Everyone Values money differently, some people really do save up to be able to afford their couple hours of entertainment during the evenings, while some of us can afford to just whip out our CC without a second though.
If the expansion comes bundled with the core game for $50 then I should get the core game (or an additional copy) regardless of whether I own it already or not if I am paying that $50.
To me this is no different than if Anet said they were only including the core game if you happened to be black. It should make no godkitten difference. If I pay $50 then I should get exactly what everyone else who pays $50 gets, regardless of any other factors.
I’m sure there’s enough fans out there to defend anet if it turned into a class action lawsuit. They’ll work their magic convincing the judge and jury how good anet have been to them in the past ^^ it works everytime in every thread ^^

I asked my Lawyer as well a few days ago. What the OP is saying is correct.
For the past few days, I have been letting people know in map chat(specially map chats with a dev in it) and forums that this is indeed a case of false advertising.
However, all I really want is a good deal with HoT, be it I get a second core account(as advertised) or a character slot for my $50 worth.
I dont want Arenanet to get sued, I dont want GW2 to go down, I dont want HoT to come out as the biggest ripoff in gaming history either.
I am holding off on the purchase of HoT in the meantime.

A game serial code for account creation or upgrade for the Guild Wars 2: Heart of Thorns expansion and the award winning Guild Wars 2 core game.
There are 2 main ways to read this:
1. This is a bundle that includes 2 items: a game code, and the GW2 core game
A game serial code for account creation or upgrade for the Guild Wars 2: Heart of Thorns expansion
-and-
the award winning Guild Wars 2 core game
2. This is a single game code that includes 2 items, one of which offers a choice between 2 options
A game serial code for:
- account creation -or- upgrade for the Guild Wars 2: Heart of Thorns expansion
- the award winning Guild Wars 2 core game.
This.
The point being that the language is ambiguous.
As khani.4786 pointed out above, she has had policy told to her in a service ticket.
I believe that official policy has been stated in this forum by a mod / ArenaNet personnel.
I just think that the sales page and FAQ should be changed so that they unambiguously match what is being stated in response to forum posts / service tickets.
If there was no ambiguity then the question would not have been asked whether the HoT expansion includes a copy of the core for all purchasers and Khani would not have their service ticket.
My only legal advice here thus far has been to eliminate that ambiguity and have wording at location X explicitly match policy as put forth in locations Y and Z, where Y and Z are not associated with the sales page or FAQ (the places a reasonable person is likely to look to determine what they are purchasing.
Also, my legal advice isn’t directed to the user base, it is to the company, as the website FAQ and Shop are the places that don’t quite have all their ducks in a row.
Again, this is not to encourage, incite, promote, or propose a lawsuit, it is simply to point out a latent ambiguity in the hopes that it gets corrected.
Oh for crying out loud…Stop with the “legal advice” crap… you guys don’t know jack
I’m not agreeing with people with legal advice, but how would you know better? The person who gave it is “supposedly” a lawyer and a few have already thought about it and have sent their complaints to ncsoft. If you know better and back it up with proof then do it, instead of claiming others of not knowing crap
I’m not a lawyer, but I have worked in retail and I do know that advertising posters and such in retail are not required to show the full Terms & Conditions on an advertising/marketing poster, only during when purchase is being made.
This is not about them not giving you the full picture.
What they describe is different from what you buy. This is false advertising. There’s a misleading statement like “A game serial code for account creation or upgrade for the Guild Wars 2: Heart of Thorns expansion and the award winning Guild Wars 2 core game.”
This could either means 2 separate codes, or 1 code for both.
This exactly and that’s why I opened a ticket only to be told yeah we didn’t mention the free core game was for only new players. A game code for item A AND item B. is ambiguous, poorly worded and can be taken either as A game code for each of the two items or a single game code that is both. (attached is the last GM reply I got. I purposefully did not include the GM’s name)
If new serial numbers being generated include the core game, then I don’t see how this is a bundle. It’s clearly not. A bundle would include more than one item. Anet is not selling the core game alone currently so I’m going to assume that the expansion version of Guild Wars 2 is now the core game. And if GW2: HoT is now the core game going forward then everyone is being made to repurchase the game in order to access the expansion (and that’s why there is no option to buy just the upgrade).
I missed the $10 sales because I couldn’t afford erroneous purchases at the time and was waiting for another sale for the core game. With their current wording lacking the exclusion or stipulations on getting the core game included I expected to get my bonus copy of the core game included too.
The invoice only shows Guild Wars 2: Heart of Thorns (Ultimate) and gives me one serial number. If the core was included as a bonus addition to the expansion I should have gotten two serial numbers to register. No where on the invoice or registration page does it say core only for new players.
I don’t fault companies like Comcast giving bonuses to new customers because they say up front in plain English that it is a new customer offer. I just want them to clarify their language and maybe give some consideration to folks re-buying the game.

https://buy.guildwars2.com/store/defaults/en_US/DisplayDRTermsAndConditionsPage/eCommerceProvider.Digital+River%2C+Inc. this does not include any language regarding what is in the package or seemingly a right to modify what is being sold (in terms of packaging).
It does provide that those who click “buy” are providing an offer to purchase that they the merchant have a right to reject. But once they accept it (i.e. you get your email with your key or w/e) it has been an accepted binding agreement.
They also reserve the right to arbitration (usually does not hold up in class action suits as class action suits are generally held before a Federal District Court and have special rules that apply in determining whether or not a class exists, and thereby whether or not the suit can proceed).
https://buy.guildwars2.com/store/defaults/en_US/DisplayDRPrivacyPolicyPage/eCommerceProvider.Digital+River%2C+Inc. this also does not include a right to modify the package being delivered.
So, the following ambiguities still exist:
“Guild Wars 2: Heart of Thorns expansion (includes Guild Wars 2 core game)” indicates that buying the expansion include the core game.
And “A game serial code for account creation or upgrade for the Guild Wars 2: Heart of Thorns expansion and the award winning Guild Wars 2 core game.” the placement of the “or” and “and” in this in addition to the prior quoted statement leave a latent ambiguity.
The FAQ’s being subject to change does not actually change the purchase rights / contract for purchasers under the prior FAQ. You would technically need a statement in there from the outset saying “sales and packaging subject to change” probably “without notice” and even then you might run risk of violating individual state’s contract laws. It’s murkier water than you want to be in.
As for any law suit not having a chance, I can’t speak to that. As stated there is no binding precedent on this type of thing. As a game developer / seller I wouldn’t want to be the one that A) pays the legal battle to settle the precedent, B) risk that precedent coming out against me, and C) having my name dragged through the legal mud and press that such a suit would entail. There’d be a lot of case law research, and possibly costly discovery, before anyone in such a suit would say “any lawsuit has a kitten’s chance in Orr of success” as this is, at least to my knowledge, uncharted territory. (Granted, if I am wrong and there is solid legal precedent to the contrary that anyone is privy to and I am not, I’d love it if someone would cite a case, this topic has become a lot more interesting to me in the last few days.)
There is perhaps one out contained here: https://buy.guildwars2.com/store/defaults/en_US/DisplayDRTermsAndConditionsPage/eCommerceProvider.Digital+River%2C+Inc.
1.3 ALL ORDERS ARE SUBJECT TO YOUR CONSENT TO ANY APPLICABLE LICENSE AGREEMENT OR USAGE TERMS IS DELIVERED WITH, INCLUDED IN, OR PRESENTED IN CONNECTION WITH YOUR PRODUCT OR DR SERVICE. If you do not agree to the license or usage terms once you see them, do not accept them and contact customer service.
The problem with this out is that somewhere before you receive and accept / apply your license there would need to be notification that your license is ONLY for expansion and not expansion and included core (like all sales documentation / FAQ). As I have not yet purchased expansion, I can’t speak to that, maybe some who have and read the agreement can. In such a case I would assume that failure to accept such a term IF included and customer support contacted would result in a full refund.
In terms of my post and user conduct:
https://www.guildwars2.com/en/legal/forum-code-of-conduct/
“Do not post legal action threads. Using the forums or PMs to encourage, promote, endorse, or incite any kind of legal action against the company or any individual is strictly prohibited. Such content will be removed, and the author’s posting privileges will be permanently revoked.”
As stated, I am not taking legal action, I am not encouraging other to take legal action, I have no plans to start, incite, or otherwise represent anyone in legal action.
I am simply bringing up that the sales documentation has ambiguities, these ambiguities have led to service tickets (one user, for example, was discussing their exasperation with it during today’s Twitch presentation of Points of Interest) and that if I were in charge of the FAQ / sales documentation I would clarify them so as to eliminate those ambiguities.

Just throwing this out there but wouldn’t a simple “FAQ’s are subject to change at the discretion of Anet” have taken care of everything ?
Again, I’m not a lawyer so I’m honestly asking this question because I really don’t know if there needs to be more to it ?
They have the right to do so. There is technically nothing wrong about it.
Yet they should do something for the players who bought it just because of that FAQ in order to restore their good reputation.

The scroll over on Basic does include: “A game serial code for account creation or upgrade for the Guild Wars 2: Heart of Thorns expansion and the award winning Guild Wars 2 core game.” which is still ambiguous based upon the placements of the “or” and “and” in that.
It’s ambiguous enough that there are threads here where people have filed complaints because they did not receive their included Guild Wars 2 core game.
I would probably change the scroll over on basic to read: “A game serial code for account creation including the award winning Guild Wars 2 core game and the Guild Wars 2: Heart of Thorns expansion; or an upgrade for an existing account including the Guild Wars 2: Heart of Thorns expansion.” in order to be clear as to what is being offered and sold.

There’s an issue of the purchase page stating: “Guild Wars 2: Heart of Thorns expansion(includes Guild Wars 2 core game)”
No mention here (https://help.guildwars2.com/entries/94582027-Heart-of-Thorns-Pre-Purchase-FAQ) that this does not include a new copy of core for a returning customer.
No mention here (https://help.guildwars2.com/entries/94582027-Heart-of-Thorns-Pre-Purchase-FAQ) that this does not include a new copy of core for a returning customer.
Under US law the offer to purchase is an open purchase offer available to any member of the public who so chooses to accept by paying the provider. Once the money has been paid creating a contract as goods / compensation have been exchanged (key to purchaser, money to provider). The problem is as far as I have been able to see, except buried in some unhappy posts in this forum the Expansion is being offered on Pre-Purchase with, and only with, the core game included BUT not EXPLICITLY stating anywhere that the purchase of the expansion does not include a copy of the core game if the purchase is used on an existing account.
I would strongly urge that the language is changed on the appropriate shop and FAQ pages.
The fact that this does not include core for returning customer only seems to be on the forum / stated in service ticket responses where people asked for their new second account.
From a legal contract perspective I would change this: “Guild Wars 2: Heart of Thorns expansion(includes Guild Wars 2 core game)” to "Guild Wars 2: Heart of Thorns expansion(includes Guild Wars 2 core game for new accounts created with this purchase) [emphasis added] ASAP. Under contract ArenaNet is offering Core + Expansion to every purchaser and only delivering Expansion to existing users. This opens them up to a class action law suit in the US, probably in Europe too considering the consumer protections.
This is not to be construed as a threat, a statement of filing suit, or anything else. But someone somewhere in the company should be aware that the way it currently reads is leaving NCSoft / ArenaNet open to a potential law suit or possible a class action law suit.
If I were part of the legal council for this company and aware of this I would immediately seek to rectify and mitigate this risk.

I don’t understand why ANET have to be stubborn about this. Just give veteran players a character slot as a bonus or 1000 gems. Is that so hard to do?
If you’re giving a bonus to new players, give bonus to veteran players too… it’s common sense…
This.
I’m not demanding or expecting $50 in free stuff for a purchase I made almost three years ago. I think it’s quite realistic to expect a little something though. A charadcter slot. A skin for crying out loud. Just something as a “thank you.” Instead? Nothing. Bupkis. And I’m supposed to be okay with this?

Has anyone also brought to peoples notice if you don’t buy HoT now you will have to most probably have to spend much more later if you want to also have the rest of the benefit of the Living Story from then on. This is not new but it does mean if you dont pay that $50 or £34.99 now you could have to pay $150 or £100 down the line for waiting. I’m also sure Anet will hold back content so after HoT is released the first LS will be a month later and that will add more dollars if you want it so even after a month your full HoT package with LS will be maybe about £45.99 or $70.
This is just a pre-purchase, you don’t get game yet. There are those adult people who really want to see first is this HoT expansion even worth for their money. And Anet is not continue LS at first day when HoT is released. If they do that then HoT content is worthless. It only means that there is nothing to do in there.
Anet have tried now 2 different type of Living Story style, 1st was Scarlet, be there or lost it forever. 2nd Living Story style was log in and you will get it for free and pay later if you dont. This HoT will be 3rd kind of Living Story style, make an expansion from it. Then they see what of these styles profit most and they will continue doing in that way Living Story.
So there are lot of us, who want to first see where we put our money, is it even worth to put our money in HoT.
This is only a computer game, our lives are not depending from that do we have HoT or not.

A thought experiment…
to all those people comming in, saying how entitled we are, little children, idiots and what not…
i wonder how you’d react if anet did cave in and from this day all bundles included 800gems extra. the reason being that the sales weren’t as good and thus they threw in another 800 gems to get people to buy it. BUT since you’ve already pre purchased wouldn’t be getting any of that, cause obviously when you bought it it was value for money.
really wonder how that would turn out…

For all those who are expecting a reply, you will not get one, they will send Gaile in again to say that they are reading the comments and taking feedback, the exact same thing when they rolled out the Megaserver and the backlash began ( granted it wasn’t as bad as this ) and still problems that where introduced with Megaserver are still in game now,
They have made theirs minds up, Anet very rarely goes back on decisions, and at this point they almost cannot, as people have already spent money on buying HOT, so they are now firmly stuck between a rock and a hard place with no way out, so sadly they will just go into hiding mode and allow this to continue, and I cannot forsee us ever getting an official response from them,
The fact that its now went mainstream across social media, and still no reply just backs this up all the more,
I can see the BLTC team pulling them out of this one, by giving away a free character slot on the BLTC.
Either way id hate to be on the Anet team right now having to explain to shareholders/parent company why what should have been a great announcement has turned into a complete and utter disaster for them.
At this point in time, I think if they did try and fix it, a lot of people have lost trust in them, and may not even buy the update anyway now, they should have been ready for this and had a back up plan in progress.
I feel sorry for Gaile who will continue to take the brunt of this, I hope shes getting a pay rise for the hassle she has to take.

To clarify: $50 is the price of the expansion. We included the core game as a free bonus to make it easier for new players to get into it.
So we early adopters are getting hosed. Lemme put it to you another way, Anet staffters: Someone who starts playing the game now gets all the content for $50. I paid roughly $50 to start with, and now I’m paying another $50 for the expansion. In what universe should I be happy to pay twice as much cause I’ve been playing longer?
So were you complaining when the base game went on sale for ten dollars because you paid five times as much? Look, you have a point here, but don’t try and overstate it.
When it was $10, I wasn’t expected to pay for it again.
Now, I’m being asked to pay for it as part of a bundle, and not even kittening get it.
You are not paying for it again. They decided to give it away for free as part of a bundle that doesn’t apply to you if you wish to link it to your existing account. That is something to complain about, but don’t misrepresent it.
Actually, we are paying for it again. Because Hot+Core is not a bundle. If it were a bundle you would have gotten two serial codes: one for core + one for Hot. I’ve gotten bundled games before, you get a serial code for every single part of the package.
Since you can’t even buy stand-alone core anymore.
HoT is the new core game. To say that HoT includes core is misleading at best.
its cause of the 39 HoM points people were able to cheat and get over the last few days. So Anet shut it down until they can roll back all the cheaters HoM points lol and to stop them from getting skins they didn’t earn.
Actually they just got the achievements , no skins
Yes, but if you have enough points you can unlock the skins by going to the merchant in the HOM. This is why it got disabled.
nah .. they got no skin .. if they obtained a portal stone , im pretty sure it was bugged just as everyone else , no one was able to get in HOM physically to visit the merch …
My GW2 account is linked to my Gw1 account , i have 30 pts in HOM , so it mean that i have a legit portal stone , before they disabled it clicking on the stone crashed the game so .. rest assured the ‘’ cheaters ’’ didn’t get any skins. They disabled it because it gave the gwamm title for free and AP achievements chest they didn’t earn.
They disabled the rewards (as in the merchant doesn’t work and pets are not there) to prevent those people whom have the undeserved points from unlocking the skins. It is obvious they currently have no skins, however they WOULD have skins now if the rewards were not disabled.
I wish the HoM wouldn’t have been bugged but this was a decent damage control move. It shows that they care about rectifying their mistakes and are working on it while preventing any further issues due to rewards being spread. It is feasible to revoke the AP and titles, it would be a nightmare to try to remove the skins/pets as well.
This is funny, because according to these forums, “Heart of Thorns” purchased directly from Anet is some form of fraud as well…

When I first saw some of the HoT talk I got really excited and decided to come back to GW2 after a year off to get back into it before HoT came out. Than my wife decided she wanted to play so I read the FAQ and it said you would need the base game to play GW2 so a couple of weeks a go we buy GW2 for her so we could play together. Now I come to find out that if we had only waited we could have bought HoT and got GW2 for free with it, but instead we dropped $40 two weeks again for GW2 and now if we want to continue playing we have to spend another $50 on her account and another $50 on my account so basicly we are out $40. This is just bull and I think we will move on to another game.

Can we just all be perfectly honest with ourselves here?
I suspect, the bulk of the complaints REALLY centers around the base edition not getting a bonus character slot. Let’s cut through the noise and just say it outright.
“Veteran” players want a kittening character slot, because they’ve filled all their slots and don’t feel they should have to buy another one on top of the expansion to play a Revenant. They feel this is cheap because GW1 handed out slots to play with in each expansion.
So can we just SAY THAT? Can we stop trying to couch it in bullkitten so that we don’t sound like “entitled brats?” Rather than run around in stupid circles over legality, quibbling semantics over whether or not the core game is actually “free” or “not free”… just say what we want here.
Arena.net. We players want a kittening character slot in the basic package. And ya know what? Most of us don’t even give a kitten if “new” players get that bonus character slot too (this entire fairness bullkitten is just another way to avoid sounding entitled to a character slot).
Yes, there’s still going to be those perpetually kitten that will never shut up about whatever perceived slight has triggered their rage bone or will always whine about the cash shop being the devil that is ruining gaming… but they’ll be relegated to the background noise again.
But put a bonus slot in the basic package, and this entire kittenstorm vanishes over kittening night. I promise you. Your problem is now solved. Smack some heads together at NCSoft and get it done.
